Welcome to Tend (“Program”), a discipleship and outreach program provided by Plant With Purpose (“we,” “us,” or “our”), a 501(c)(3) nonprofit organization based in the United States.

These Terms and Conditions (“Terms”) govern your access to and use of the Tend website, Tend kit materials (including Leader, Dinner & Discussion, Activity, and Hospitality Guides), and related services (collectively, the “Services”).

By clicking “I Accept,” registering for an account, or accessing the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Registration, Account Security, and Eligibility

1.1 Eligibility

To use the Services, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By registering, you represent that you are authorized to act on behalf of the church or ministry group you are representing, if applicable.

1.2 Account Creation

You agree to provide accurate, current, and complete information during the registration process. You are responsible for keeping your account information up to date.

1.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to or use of your account. You are responsible for all activities that occur under your account. Plant With Purpose is not liable for any loss or damage arising from your failure to protect your account.

2. Special Provisions for Pastors and Church Leaders

Because the Tend platform allows Pastors and Church Leaders to view information related to multiple groups, the following specific obligations apply to any user granted administrative or oversight access:

  • Confidentiality: You agree to keep all member and group leader information confidential. You must not share, sell, or disclose personal data visible in your dashboard to any third party outside of authorized ministry purposes.
  • Proper Use: Data accessed through the Pastor dashboard is intended solely to support discipleship and manage the Tend program within your church. Misuse of data (e.g., harvesting emails for marketing, personal grievances, or unrelated solicitations) is strictly prohibited.
  • Monitoring: You acknowledge and agree that Tend logs and monitors account access and activity to ensure the security of the platform and compliance with these Terms.
  • Suspension: Plant With Purpose reserves the right to immediately suspend or revoke your administrative access if we detect or suspect any misuse of member data or breach of confidentiality.

3. Intellectual Property and License to Use

3.1 Ownership

The Tend website, the Tend kit (including all guides, curricula, text, graphics, and logos), and the underlying software are the exclusive property of Plant With Purpose or its licensors and are protected by U.S. and international copyright laws.

3.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, print, and use the Tend kit materials solely for non-commercial, ministry, and educational purposes within your church or group. This license permits use within a single church, ministry, cohort, or facilitated group, but does not permit redistribution or reuse beyond that context without prior written permission from Plant With Purpose.

3.3 Restrictions

You may not sell, resell, or exploit the Tend materials for commercial gain. You may not alter or remove any copyright or proprietary notices contained in the materials. You may not create derivative works from the Tend materials or remove identifying marks, logos, or attributions, except for limited contextual adaptations permitted for use within your church or group.

4. Acceptable Use and Prohibited Conduct

You agree to use the Services only for lawful purposes. You agree NOT to:

  • Illegal Activity: Use the Services for any unlawful purpose or in violation of any local, state, or federal law.
  • System Abuse: Interfere with or disrupt servers or networks connected to the Services, or attempt to bypass, compromise, or misuse system safeguards, including the transmission of worms, viruses, spyware, or other harmful code.
  • Scraping/Bots: Use any robot, spider, scraper, or other automated means to access the Services or extract data.
  • Mass Downloading: Engage in mass downloading of content that burdens our system or implies an intent to redistribute our content outside the permitted scope.
  • Harassment: Harass, threaten, defame, or intimidate other users or Plant With Purpose staff.
  • Reverse Engineering: Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services.

5. User-Generated Content (UGC)

5.1 Ownership

You retain ownership of the content you submit to the Services, including but not limited to photos of your group, survey responses, and comments (“User Content”).

5.2 License to Plant With Purpose

By submitting User Content, you grant Plant With Purpose a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with the Services and Plant With Purpose’s mission, including program improvement, reporting, and storytelling.

5.3 Warranties regarding UGC

You represent and warrant that:

  1. You own or have the necessary rights and permissions to use and authorize us to use your User Content (including consents from individuals appearing in photos).
  2. Your User Content does not infringe the intellectual property or privacy rights of any third party.
  3. Your User Content is accurate and not misleading.

5.4 Right to Remove

We have the right (but not the obligation) to monitor, edit, or remove any User Content at any time, for any reason, including content that we believe violates these Terms.

6. Disclaimers and Limitation of Liability

6.1 “As-Is” Disclaimer

The Services and all materials provided via Tend are provided on an “AS IS” and “AS AVAILABLE” basis. Plant With Purpose expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

6.2 Limitation of Liability

To the fullest extent permitted by law, Plant With Purpose shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Services;
  • Any conduct or content of any third party on the Services;
  • Any content obtained from the Services.

To the extent permitted by law, Plant With Purpose’s total liability for any claim arising out of or relating to the Services shall not exceed the amount, if any, paid by you to access the Services.

6.3 Educational Nature of Content

Tend is provided for educational and formational purposes only. The content is not intended to constitute legal, medical, financial, counseling, or other professional advice. Users are responsible for how they interpret and apply the materials within their own contexts.

7. Indemnification

You agree to indemnify, defend, and hold harmless Plant With Purpose, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Services;
  • Your violation of these Terms;
  • Your User Content;
  • Your violation of any third-party right, including intellectual property or privacy rights.

8. Third-Party Links and Resources

The Services may contain links to third-party websites or resources. We provide these links only as a convenience and are not responsible for the content, products, or services on or available from those websites. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites.

9. Termination

9.1 Right to Terminate

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including material violations of these Terms or misuse of the Services, as determined in good faith by Plant With Purpose.

9.2 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may, at our discretion, delete or archive your User Content and data, subject to our legal obligations.

9.3 Survival

All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Privacy Policy

Your use of the Services is also governed by the Plant With Purpose Privacy Policy, available at https://plantwithpurpose.org/privacy-policy/. This policy describes how we collect, use, and share your personal information. By using the Services, you consent to the data practices described in that Privacy Policy.

11. Modification of Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice to you via the email address associated with your account or by posting a prominent notice on the website.

Your continued use of the Services following the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Services.

12. Miscellaneous

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
  • Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control (e.g., mechanical, electronic, or communications failure or degradation).
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
  • Assignment: These Terms are not assignable or transferable by you without our prior written consent. We may assign these Terms without restriction.
  • Entire Agreement: These Terms (and the Privacy Policy) constitute the entire agreement between you and Plant With Purpose regarding the Services.
